“Oliver took a clip of a month`s worth of phone records and displayed them on national tv as a means of making a spot about the government`s curiosity about the private lives of citizens. It would be unconstitutional for a private party to permit such disclosure patently, however the government does not have an identical interest. The Supreme Court has held that the Fourth Amendment protects people not the contents of their communications. In this respect, the ACLU was right. Nonetheless it was wrong in its use of the past tense. The federal government hasn`t “looked” at this information. It has obtained this information with a subpoena and the info in Oliver`s clip is lawfully on its files. Oliver`s clip was a form of fishing expedition. In Oliver`s context, that is clearly a fact. But Oliver`s context is irrelevant to the relevant standard for finding a search warrant in a federal case. As discussed in greater detail within an earlier article, the main element question is whether the government used the “unidentified source” of Oliver`s data. Here, the government claimed that Oliver`s call detail records were an “unidentified source” of the FBI`s call detail records, and that Oliver`s use of a clip of those records was unprotected conduct. So, Oliver`s use of the clip was protected, and it did not help Oliver that he did not have the main element pieces of information he needed to corroborate his defense. Oliver had not reviewed the call detail records actually. He knew nothing about any subpoenas to produce the records.

However, Oliver`s use of the clip did donate to the government`s finding a search warrant to examine a month`s worth of phone records. Oliver`s use of a clip was therefore legal, and it did not hurt Oliver that he did not actually have the main element pieces of information he needed to corroborate his defense.

The key question is whether the government used the “unidentified source” of Oliver`s data. Here, the government claimed that Oliver`s call detail records were an “unidentified source” of the FBI`s call detail records, and that Oliver`s use of a clip of those records was unprotected conduct. Oliver`s use of a clip was therefore legal, and it did not hurt Oliver that he did not actually have the main element pieces of information he needed to corroborate his defense. Rather, the government argued that Oliver`s access of the URL is highly recommended a use of the Stored Communications Act. As the national government relied on that reasoning, the claim was denied and the wiretap case against Manning was permitted to stand.

I do not find it essential to address this aspect. The claim that Manning accessed a URL with the only real reason for accessing a foreign website had not been the type of access that entitled Manning to assert the defenses provided by the Stored Communications Act, but was a secondary use of the URL instead, and was thus not grounds for Manning to assert the defenses.

As the Stored Communications Act allows plaintiffs to assert defenses based on the circumstances of their usage of the webpage, an initial use defense is not needed. In fact, I believe that should be the standard. The primary purpose of the use of a URL is defined as “the one intended by the web site operator in directing users to the URL.” However, if the defendant initiates the use of the URL, then it will only be available to the defendant`s usage, not the intended use of the web site operator.

I disagree with the Court of Appeals` decision. It was wrong on both legal history and theory.
Initially, this seems such as a slam dunk case. The court`s reasoning appears to be that because Manning accessed the webpage because he was on a work computer and on work premises, he will need to have designed to access the webpage on behalf of his employer. And what do the known facts show? Manning accessed the page because he had an urgent need to get hold of someone. It could have even been because he had an urgent need to get hold of his wife. Therefore, he did not view the webpage for personal use, but viewed the webpage on behalf of his employer instead. Therefore, he violated the Stored Policy. This decision seems to support the court`s rationale. Again Then, this is the first time this decision has been handed down in an injury context. That is definitely at the mercy of a different interpretation than when it was handed down in the telecommunications context. For the reason that context, Stored Communications (later known as Cogent Communications) was trying to decide the issue of whether or not a supervisor could be liable for a subordinate`s access of the supervisor`s work computer.

In that case, Cogent argued that supervisors had a duty of care for the subordinates they employed, and because the supervisor`s usage of the task computer had not been for work related purposes, the supervisor cannot be liable. In that case, Cogent held the supervisor liable for the subordinate`s usage of the computer. But in this case, the court had a different position. The court ruled that Stored did not have the rights to terminate the access as it occurred. The access only became terminationable when Manning decided to send an email to a customer support agent, explaining his actions. The court relied on your choice in Newland v. United Airlines, Ltd. where in fact the court held that whenever a passenger was provided by an airline with a meal, ticket, boarding passes and the chance to use the airport`s terminal, and informed the passenger that they cannot be held accountable for any actions on the passenger`s behalf if the passenger did not do anything, the right was lost by the airline to terminate the meal, ticket, boarding passes, and terminal access when the passenger boarded the plane.

. Volunteering. There are a lot of outstanding ways for you to volunteer at church, with civic groups or in the arts that you can remain constantly engaged. Not just do you get the satisfaction of doing something helpful for others, you get out and meet people which is a sure treatment for solitude
. Church. They always have ways for you to be involved during the day if you are active in your church. A few of them will be volunteer opportunities however others may simply be participating in a great bible research study or social time with your Sunday School class
. Pitch in with the grandkids. This is a wonderful way to get out. You like those grandkids and by giving your children a method to get out and leave them in a trusted place, you do them good and get tons of great play time with those sweet children.

These are simply a few great ways for you to get out and meet people who will welcome you with open arms. These are locations of life that are eager for a passionate Grandma or Grandpa to jump in feet forward and get involved. Getting involved means remaining engaged and remaining engaged means never feeling lonely again. Which is the long-term treatment for solitude. A senior community can definately be of assistance. This company helps promote these communities with these services but they also would know some great communities to look in to:

• increase retirement community sales
• senior housing direct mail marketing help

The issue of solitude is persistent in senior residents so it`s excellent to get out ahead of it so it doesn`t trigger major problems the longer it goes on.

Lessons I have learned about Alkaline Water

When I began drinking ionized alkaline water I didn’t even know what an ion was.

I failed gloriously at chemistry at school. I was the class disruptor. The idea of a universe of elements confined to a single table of values was anathema to me. I wanted infinite possibility rather than the confines of a periodic table that explained the ‘Theory of Everything’.

Well, things have changed.

I’m still no expert in chemistry but I’ve grown to love the process of learning about a subject that fascinates me; the relationship of pH balance to my – and others’ – health.

Alkaline Water and pH Balance

As I learned that the world in general refuses to accept the huge advantage of an alkaline body, I delved into physics, chemistry, biology and psychology.

Strangely, I look back on myself at school and understand that unless a person is ready to learn – and change – they simply can’t hear even hear the words of their best friends when it interferes with their idea of normal life.

Enough of the philosophy; you are reading this to learn about alkaline water, so let’s get on with it.

If you’ve come this far you’ve probably already been exposed to some form of information, most likely from someone attempting to sell you a water ionizer. So let’s begin at the beginning with the word ‘ion’.

An ion is an atom. Got that? Good.

You are half way. But it’s an atom that carries an electrical charge, or is in need of an electrical charge.. so if you like, it’s an electrically unbalanced atom.

Of course nothing is imbalanced in nature. So an atom with a positive electrical charge has just one purpose in creation; it is looking for an ion that is missing a charge so it can donate its charge, and return to normal atomic state of equilibrium. It’s a completely beneficial meeting for both atoms involved because they both return to being just atoms instead of ions.

They return to balance.

It took me some time to see the significance of this and I wish my chemistry teacher had told me about ions and what I’m about to share. (Of course, he did, but I was busy disrupting.)

We read about chemical reactions everywhere; in the air, in the earth, in industry and medicine, and within our body. A chemical reaction is the action of ions co-operating to create a new molecular substance.

They give and they take and they form a stable substance rather than simple separate atoms. So ions are the key to all chemical reactions plus the formulation of new substances.

This extends from simple salt – a joining of ionic sodium and ionic chlorine – all the way up the high level multi-atom substances.

But we don’t need to worry about getting into the understanding of complex substances because ionized water is a very simple ionic transfer. Basically, it’s the creation of a new form of water that has more negatively charged ions in it than usual.

You probably think that there’s just one way to do this. That’s not true; there are a number of ways including magnetics, electrolysis and passing water over certain reactive elements. The latter is the cause of the amazing so-called ‘healing’ springs around the world, evidenced simply by a lighter molecular weight of these special waters.

I have experienced excellent health (in the main) over my 21 years of alkaline water based life.

I don’t attribute all of it to ionized alkaline water but it’s my personal belief that so many years without my usual annual colds and flu has something to say about the water’s immune support abilities. You’ll find hundreds of testimonials for the water online and although in my opinion most of them are real, I need to caution you that nothing fixes everything and every case needs to be seen in the context of their previous lifestyle choices.

To give a simple example – when did you ever see a diet that didn’t claim miraculous benefits from ‘Mrs J. Smith of Alabama”.

The reality of all diets is that if a person is already slowly killing themselves with the SAD (Standard American Diet) anything a little healthier will provoke a healing response.

Was it the specific diet? Yes..and no.

The specific diet provoked the response but any diet of equal quality would probably have done the same. So please be a little careful in your research.

I think I can assist you hugely today because I’m going to share a meta-analysis of over 100 international studies of the health effects of natural alkaline water. And then I’ll attempt to show you the differences between electrically created – and natural alkaline water. There are very important differences as well as very important similarities.

The study: and what I learned.

The study linked to here is the best piece of information on alkaline water I have read for 13 years. It is completely crossreferenced to actual studies, which makes it head and shoulders above any other form of document you would usually read on the net. What it says is as correct as science has managed to make it. (The foundation of scientific inquiry is that your study’s result is correct only until someone proves otherwise.)

So what does it say about Alkaline Water?

It concentrates on the two major elements of alkaline water in nature; Calcium and Magnesium.

“Both of these elements are essential for thehuman body. Calcium is a part of bones and teeth. In addition, it plays a role in neuromuscular excitability (decreases it), good function of the conducting myocardial system, heart and muscle contractility, intracellular information transmission and blood coagulability.”

It goes on to say that osteoporosis and osteomalacia are the most common symptoms of Ca and Mg deficiency.

Please note: it does NOT say directly that more calcium will cure these conditions. We’ve independently researched this and there’s a much bigger story here. But let’s move on. (If you’d like to know more go here)

The report then talks about the superstar of alkaline minerals, Magnesium:

“Magnesium plays an important role as a cofactor and activator of more than 300 enzymatic reactions including glycolysis, ATP metabolism, transport of elements such as Na, K and Ca through membranes, synthesis of proteins and nucleic acids, neuromuscular excitability and muscle contraction etc. … Magnesium deficiency increases risk to humans of developing various pathological conditions such as vasoconstrictions, hypertension, cardiac arrhythmia, atherosclerotic vascular disease, acute myocardial infarction, eclampsia in pregnant women, possibly diabetes mellitus of type II and Osteoporosis.”

Think about it.

Is there a pill anywhere on earth that gives so much benefit? It’s so commonly available, so well researched to PROVE these claims, yet most of us (according to the report) are severely lacking magnesium in our diet!

Although there were some scattered studies as early as 1927 recommending hard water over soft, it wasn’t until 1950 when Japanese scientists concluded that hard alkaline water was more beneficial than soft water in the prevention of cardiovascular disease.

To be very clear, they found higher mortality rates from cerebrovascular diseases (stroke) in the areas of Japanese rivers with more acid (i.e. softer) water compared to those with more alkaline (i.e. harder) water used for drinking purposes.
